Terms and Conditions

These terms cover the Sunsetless EWS software and the sunsetless.com website. By buying, installing or using Sunsetless EWS, or by using the website, you accept them.

1. Who we are

  • Sunsetless is a brand of Jacek Marchewka One (sole proprietorship), C17/11, 32-086 Węgrzce, Poland, tax and EU VAT ID PL5130235098 ("we", "us").

  • "You" means the business that buys or uses Sunsetless EWS. The person who accepts these terms confirms that they may do so for that business.

2. Business customers

  • Sunsetless EWS is a developer tool for businesses. By buying or using it, you confirm that you act for a business, not as a consumer.
  • If mandatory consumer law still applies to you, nothing in these terms limits your rights under it.

3. Paddle is our reseller

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

  • Paddle's Buyer Terms govern the purchase: payment, tax, invoices and any consumer rights.
  • These terms govern the licence (what you may do with Sunsetless EWS) and the website. They are the supplier terms that Paddle's Buyer Terms refer to.
  • Paddle answers questions about orders, payments, invoices and refunds at paddle.net. We provide product support and licence keys.
  • Prices are in US dollars, excluding tax. Paddle adds VAT or sales tax where it applies.
  • You can buy only through the checkout on sunsetless.com.

4. Licence

  • Production use needs a paid licence. "Production" means use that serves real users or business processes.
  • You can try Sunsetless EWS with your own application: every licence has a 14-day money-back guarantee (see the Refund Policy).
  • After payment we grant you a non-exclusive, perpetual, worldwide licence for production use within your licence type:

  • Only production counts towards your licence type. Development, test and staging in your licensed tenant need no extra licence. If you need a separate test tenant, contact us.
  • Right after payment you get a test key. It works in any tenant for 30 days.
  • From 14 days after your purchase, you create your permanent licence key in your account. A Single App or Organization key is tied to the one Microsoft 365 tenant you enter there; an ISV key is not tied to a tenant. The permanent key does not expire.
  • To move your licence to another tenant, for example after a tenant migration, contact us. We issue a key for the new tenant, and you stop using the old one.
  • The licence key does not identify your applications. These terms set how many you may run in production, and you must keep to them.
  • One application may run on any number of servers.
  • The licence key works offline. Sunsetless EWS never contacts us to check it.
  • You may transfer the licence only with our written consent. We will not refuse it without good reason, for example when you sell your business or product.

5. Updates, support and renewal

  • Each licence includes 12 months of updates and support from the purchase date. For licences bought at the launch price, see section 9.
  • Updates are all Sunsetless EWS versions released in that period. You may use them forever.
  • Support is by email, in English, on business days. It covers help with installing and using Sunsetless EWS and bug reports. We aim to reply within 2 business days; this is a target, not a guarantee.
  • Renewal is optional. It adds 12 months of updates and support for 50% of the current list price, also for licences bought at the launch price (for example, $745 for Single App at the current list price). If you renew after your period has ended, the new 12 months start on the renewal date.
  • A paid licence never stops a running application. Sunsetless EWS checks the key once, when your application starts: that the key is genuine, that a test key has not expired, that a permanent key is for the tenant your application signs in to, and that the package was released before your update period ended. A version released later will not start until you renew. You see this at startup, so test upgrades before you deploy them.

6. What you may not do

You may not:

  • use Sunsetless EWS in production beyond your licence type;
  • share or publish your licence key, or remove or bypass the licence check;
  • sell, rent or sublicense Sunsetless EWS on its own, or offer it as a library or service for others to build on;
  • decompile or reverse engineer Sunsetless EWS, except where the law or the MIT License (section 7) allows it;
  • use Sunsetless EWS in breach of the law, sanctions or export rules, or Microsoft's terms for its services.

ISV licence: you may ship Sunsetless EWS inside your product to your customers without royalties. Your customers may use it only as part of your product. Keep our copyright and licence notices.

7. Open-source code and ownership

  • Sunsetless EWS includes code from the EWS Managed API, © Microsoft Corporation, licensed under the MIT License. That code stays under the MIT License, and nothing in these terms limits your rights under it. The notices ship with the package.
  • The rest of Sunsetless EWS, including the Microsoft Graph translation layer, belongs to us. We license it to you; we do not sell it.
  • Your applications and your data remain yours.

8. Your data and Microsoft services

  • Sunsetless EWS runs inside your application. It connects to Microsoft Graph directly, with your own app registration and credentials.
  • We do not receive, store or process your mail, tokens or credentials. Sunsetless EWS sends no data to us. For the data in your mailboxes we are neither controller nor processor.
  • You are responsible for your app registration, permissions and certificates, and for lawful access to the mailboxes you use.
  • Microsoft runs Microsoft Graph and Exchange Online and may change, limit or throttle them. Known limitations are listed on sunsetless.com. We will try to adapt Sunsetless EWS in updates, but we are not responsible for Microsoft's services or for any change, limit, outage or retirement of them.
  • Please do not send us mailbox content or other personal data with support requests. If you must, ask us first.

9. Delivery and launch prices

  • Right after payment you can download Sunsetless EWS from your account on sunsetless.com, and we email you a test key valid for 30 days. From 14 days after your purchase, you create your permanent licence key in your account (section 4).
  • Your account is created automatically from the email address you give at checkout. To sign in, you enter a one-time code that we email to you. There are no passwords.
  • In your account you find your licence keys and every version released during your update period.
  • We may also publish Sunsetless EWS on NuGet.org. Wherever you get it from, it works with Microsoft Graph only with a valid licence key, and these terms apply.
  • sunsetless.com distinguishes current package coverage, EWS operations that Graph can support but the package does not yet implement, and operations for which Microsoft Graph has no production-supported API. We will support every EWS operation that has a production-supported Graph equivalent and add it to the coverage matrix after implementation and testing. Where Graph has no production-supported API, the wait depends on Microsoft adding that capability.
  • Our launch price applies to licences bought until December 15, 2026: $899 (Single App), $2,390 (Organization), $3,590 (ISV), plus tax. That is about 40% below the list price.
  • Licences bought at the launch price include updates and support until December 31, 2027. In all other respects they are the same as other licences.

10. Refunds

Every licence has a 14-day money-back guarantee. Refunds follow our Refund Policy, and Paddle processes them. After a refund the licence ends: you can no longer download Sunsetless EWS or create a permanent licence key, and your test key stops working when it expires. You must also remove Sunsetless EWS from production, as the Refund Policy explains.

11. No warranty

  • Sunsetless EWS and the website are provided "as is" and "as available", with all faults. You use them at your own risk.
  • As far as the law allows, we give no warranties or guarantees of any kind, express or implied. In particular, we do not promise that Sunsetless EWS is fit for your purpose, works without errors or interruptions, behaves exactly like EWS, or keeps working when Microsoft changes its services. We exclude the statutory warranty for defects under the Polish Civil Code (rękojmia).
  • The coverage, known differences and test results on sunsetless.com describe what we have tested. They are information, not a promise that your application will behave the same way.
  • You alone decide whether Sunsetless EWS suits your application. Test it with your application before production; the 14-day money-back guarantee is there for that.
  • During your update period we try to fix confirmed bugs as part of support. We do not promise that every bug will be fixed, or by when.

12. Liability

  • As far as the law allows, we are not liable for any loss or damage connected with Sunsetless EWS, the website or these terms, whether under contract, tort or any other legal basis.
  • In particular, we are not liable for: lost profits, revenue, business or goodwill; lost, damaged, sent, deleted or changed emails, calendar items or other mailbox data; messages or notifications sent by Microsoft services; business interruption; the acts of Microsoft, of your application or of anyone else; or any indirect or consequential loss.
  • Where the law allows us to limit our liability but not to exclude it, our total liability for all claims about a licence is limited to the amount you paid for that licence in the 12 months before the event that caused the claim.
  • Nothing in these terms excludes or limits liability that the law does not allow us to exclude or limit, such as liability for damage caused intentionally.
  • You are responsible for your application, for how it uses mailboxes, and for backups.
  • If a third party, such as a mailbox owner or one of your customers, makes a claim against us because you used Sunsetless EWS in breach of these terms or the law, you will cover our losses and reasonable costs of that claim.

13. Ending the licence

If you seriously breach these terms and do not fix the breach within 30 days of our notice, we may end your licence. You must then stop using Sunsetless EWS in production. Sections 7, 11, 12 and 18 continue to apply.

14. Sunset clause

  • If a sunset event happens, we give every licence holder (anyone with a paid licence that has not ended) the complete source code of the latest Sunsetless EWS release under the MIT License, within 30 days.
  • A sunset event is any of these:
    1. we announce that we have stopped developing Sunsetless EWS;
    2. we publish no new Sunsetless EWS release for 12 consecutive months;
    3. our business stops trading (for example, it is removed from the Polish business register, CEIDG), and no successor takes over these terms.

15. Website and trademarks

  • The website gives general information and may change. For the licence, these terms apply.
  • Do not attack, overload or misuse the website.
  • Microsoft, Exchange, Outlook and Microsoft Graph are trademarks of the Microsoft group of companies. Sunsetless is not affiliated with, endorsed or sponsored by Microsoft. We use these names only to describe what Sunsetless EWS works with. "EWS" in the product name only says that it works with code written for Exchange Web Services.

16. Changes to these terms

We may update these terms. The version you accepted at purchase applies to that licence. A renewal falls under the terms in force on the renewal date. The date at the top shows the current version.

17. Complaints

Email [email protected] with "Complaint" in the subject. We confirm receipt within 2 business days and reply in full within 14 days. For payments and refunds, you can also contact Paddle at paddle.net.

18. Law and disputes

  • Polish law governs these terms. The UN Convention on Contracts for the International Sale of Goods does not apply.
  • Disputes go to the common court competent for our place of business in Poland, unless mandatory law says otherwise.
  • These terms, the Refund Policy and the Privacy Policy are the whole agreement about the licence, unless we sign a separate agreement with you.
  • If a clause is invalid, the rest remains in force.
